1. Applicability

These Terms and Conditions (“Terms”) govern your use of the website located at perfectwalls-llc.com (the “Site”) and your engagement of Perfect Walls, LLC (“Perfect Walls,” “we,” “us,” or “our”) for painting, drywall, remodeling, design, and related residential and commercial services (the “Services”) serving the greater Chicago, Illinois area, including Naperville and surrounding communities.

By accessing the Site, submitting a quote request, or engaging Perfect Walls for Services, you agree to these Terms. If you do not agree, please do not use the Site or our Services.

2. Service Agreement Priority

If you sign a written estimate, proposal, or Service Agreement with Perfect Walls for a specific project, that document governs the scope of work, pricing, materials, and schedule. These Terms apply to your general use of the Site and to our relationship where your Service Agreement is silent. If the two conflict, your signed Service Agreement controls.

3. General Provisions

These Terms, together with our Privacy Policy and any signed Service Agreement, form the agreement between you and Perfect Walls. We may update these Terms from time to time. Changes take effect once posted to the Site. Continuing to use the Site, or continuing to engage us for Services, after changes are posted means you accept the updated Terms.

4. Estimates and Quotes

Estimates provided in person, by phone, or through the Site’s quote request form are good-faith projections based on the information available at the time. They are subject to change once we confirm the scope of work, site conditions, and material selections. The price that governs your project is the one set out in your signed Service Agreement or invoice.

5. Payment Terms

• Deposit: projects may require a deposit before work begins, as specified in your Service Agreement.
• Progress and final payment: additional payments may be due at agreed milestones, with final payment due upon substantial completion unless otherwise agreed in writing.
• Accepted payment methods and any processing fees will be confirmed in your Service Agreement.
• Change orders: any change to the scope of work requested after the Service Agreement is signed, including material upgrades or additional work, will be documented in a written change order and may affect price and schedule.

6. Cancellation and Rescheduling

Cancellations or rescheduling may be subject to costs already incurred by Perfect Walls, including specially ordered or non-returnable materials and work already performed, as provided in the applicable Service Agreement.

7. Warranty

Perfect Walls stands behind its workmanship. Specific warranty coverage and duration are set out in your Service Agreement or invoice. This warranty does not cover damage from normal wear and tear, misuse, structural settling, moisture intrusion unrelated to our work, pre-existing conditions, substrate failure, or work performed by others after project completion.

8. Use of the Site

When using the Site, you agree that you will not:

1. Use the Site for any unlawful, harmful, or fraudulent purpose
2. Post or submit content that is defamatory, obscene, infringing, or otherwise inappropriate
3. Interfere with or disrupt the Site’s functioning, including by hacking or transmitting viruses

We may restrict or terminate your access to the Site if you violate these Terms.

9. Intellectual Property

All content on the Site, including text, images, photographs of completed projects, graphics, logos, and design elements is the property of Perfect Walls or used with permission. You may view or download content for personal, non-commercial reference only, provided all copyright notices remain intact. Unauthorized reproduction, distribution, or commercial use of Site content is prohibited.

10. Project Photos and Testimonials

With your permission, Perfect Walls may photograph completed work and use those images, along with any reviews or testimonials you provide, in our portfolio, marketing materials, and on the Site. We will not publish images that reveal your address or other identifying details without your consent.

11. Privacy and Security

Your use of the Site is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information.

12. Disclaimer of Warranties (Site)

The Site is provided on an “as is” and “as available” basis. We make no guarantees regarding the accuracy, reliability, or uninterrupted availability of the Site and disclaim all warranties, express or implied, to the fullest extent permitted by law, except the express workmanship warranty provided in your Service Agreement.

13. Limitation of Liability

To the fullest extent permitted by law:

• Perfect Walls is not liable for indirect, incidental, punitive, or consequential damages, including loss of data or profits, arising from your use of the Site.
• For claims related to Services performed, our total liability will not exceed the amount you paid Perfect Walls for the Services giving rise to the claim.

14. Governing Law and Jurisdiction

These Terms are governed by the laws of the State of Illinois, without regard to conflict of law principles. Any dispute arising from these Terms or our Services will be brought exclusively in the state or federal courts located in DuPage County, Illinois.

15. Marketing Communications

By providing your phone number or email through the Site, you consent to receive messages from Perfect Walls about your inquiry, project updates, and promotions, in accordance with our Privacy Policy. You may opt out at any time by replying “STOP” to text messages, using the unsubscribe link in emails, or contacting us directly. Message and data rates may apply, message frequency varies.

16. Indemnity

You agree to indemnify and hold Perfect Walls harmless from claims, damages, or expenses arising from your breach of these Terms or misuse of the Site.

17. Entire Agreement

These Terms, our Privacy Policy, and any signed Service Agreement constitute the entire agreement between you and Perfect Walls regarding the Site and our Services.
